Please read this agreement carefully. By downloading, installing, or using Futbol AI, you agree to be bound by the terms and conditions of this End User License Agreement. If you do not agree to these terms, do not download, install, or use the App.
1. Agreement Overview
This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User," "you," or "your") and Epinko Teknoloji ("Licensor," "Company," "we," "us," or "our") for the use of the Futbol AI mobile application ("App" or "Licensed Application"), including any updates, supplements, and related services.
This EULA is entered into between you and Epinko Teknoloji only, and not with Apple Inc., Google LLC, or any app store operator. Epinko Teknoloji is solely responsible for the Licensed Application and its content.
2. License Grant
2.1 Scope of License
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the App on devices that you own or control, as permitted by the applicable app store's terms of service.
- Access the App's features, including free and premium subscription features, in accordance with your subscription status.
2.2 License Restrictions
You may not:
- Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App or its content.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent permitted by applicable law.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Use automated systems, bots, scrapers, or similar tools to access or interact with the App.
- Circumvent or attempt to circumvent any technological protection measures, rate limits, or access controls.
- Share your subscription access with others or use a single subscription across multiple accounts.
- Use the App to provide commercial betting advisory, tipster, or prediction services to third parties.
- Redistribute, republish, or commercially exploit the AI-generated analyses or predictions.
2.3 Device Limits
You may install the App on any device that you own or control, subject to the applicable app store usage rules. Your subscription is tied to your anonymous account and can be restored across devices through the App's restore purchases feature.
3. Subscription Terms
3.1 Free and Premium Features
The App offers both free and premium features:
- Free Features: Live scores, basic match information, and limited functionality.
- Premium Features ("FutbolAI Pro"): Full AI-powered match analysis, all league coverage, betting predictions with confidence scores, advanced statistics, injury reports, and lineup data.
3.2 Auto-Renewable Subscriptions
Premium features require a paid subscription. By purchasing a subscription:
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
- You can manage and cancel your subscription in your device's account settings (App Store or Google Play).
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
3.3 Price Changes
We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after the price change takes effect constitutes your agreement to pay the new price.
3.4 Refunds
Refund requests are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies. We do not directly process refunds. To request a refund:
4. Intellectual Property
4.1 Ownership
The App, including all content, features, and functionality (including but not limited to design, text, graphics, logos, icons, algorithms, AI models, and software), is owned by Epinko Teknoloji and is protected by international copyright, trademark, and other intellectual property laws.
4.2 AI-Generated Content
The AI-generated analyses, predictions, and commentary within the App are produced by our proprietary systems and remain the intellectual property of Epinko Teknoloji. You may use this content for personal, non-commercial purposes only.
4.3 Third-Party Content
Football data, team logos, player information, and related content are provided by third-party data providers (API-Football). Such content is subject to the respective providers' terms and is used under license.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
5.1 No Guarantee of Accuracy
We do not warrant that:
- The AI predictions, analyses, or statistical data will be accurate, complete, or reliable.
- The App will be uninterrupted, timely, secure, or error-free.
- The results obtained from the use of the App will meet your expectations.
- Any errors in the App will be corrected.
5.2 Prediction Accuracy Disclaimer
All predictions and analyses are statistical estimates based on historical data and AI models. They do NOT guarantee future outcomes. Past performance of predictions does not indicate future results. The accuracy of predictions may vary significantly, and no prediction system can consistently predict sports outcomes with certainty.
6. Gambling and Betting Disclaimers
IMPORTANT: Futbol AI is NOT a gambling application. The App does not facilitate, enable, or process real-money betting or gambling transactions. The App provides analysis and predictions for informational and entertainment purposes only.
6.1 No Gambling Services
The App:
- Does NOT accept, process, or facilitate any wagers, bets, or gambling transactions.
- Does NOT connect to or integrate with any betting operator, sportsbook, or gambling platform.
- Does NOT provide odds for the purpose of placing real-money bets.
- Does NOT guarantee any financial return or profit.
6.2 User Responsibility
If you choose to use the information provided by the App in connection with any betting or gambling activities:
- You do so entirely at your own risk and discretion.
- You are solely responsible for complying with all applicable laws and regulations in your jurisdiction regarding gambling and betting.
- You acknowledge that gambling may be illegal in your jurisdiction, and it is your responsibility to determine the legality.
- Epinko Teknoloji accepts no liability for any financial losses resulting from betting or gambling decisions made based on the App's content.
6.3 Responsible Gambling
If you participate in gambling activities, we encourage responsible gambling practices:
- Set a budget and stick to it. Never bet more than you can afford to lose.
- Do not chase losses. If you are losing, take a break.
- Gambling should be entertainment, not a source of income.
- If you believe you have a gambling problem, seek help from organizations such as Gamblers Anonymous or your local gambling support service.
6.4 Age Restriction
The App and its content are intended for users aged 18 and older (or the legal gambling age in your jurisdiction, whichever is higher). By using the App, you confirm that you meet this age requirement.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Epinko Teknoloji shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Epinko Teknoloji shall not be liable for any financial losses arising from betting, gambling, or investment decisions made based on the App's content, predictions, or analyses.
- Our total liability for all claims arising out of or relating to this EULA or the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
- These limitations apply regardless of the legal theory on which the claim is based, whether or not we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless Epinko Teknoloji, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use or misuse of the App.
- Your violation of this EULA.
- Your violation of any applicable law or regulation.
- Any gambling or betting activities you undertake based on the App's content.
9. Termination
9.1 Termination by You
You may terminate this EULA at any time by uninstalling the App and canceling any active subscriptions through your Apple ID or Google Play account settings.
9.2 Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice, if:
- You breach any term of this EULA.
- You engage in abusive, fraudulent, or harmful behavior.
- You attempt to circumvent rate limits, access controls, or security measures.
- We are required to do so by law.
9.3 Effects of Termination
Upon termination:
- Your license to use the App is immediately revoked.
- You must uninstall all copies of the App from your devices.
- Sections 4-8, 10-12, and any other provisions that by their nature should survive, will survive termination.
10. Apple-Specific Terms
For Users Who Downloaded from the Apple App Store
The following terms apply in addition to the above:
- This EULA is between you and Epinko Teknoloji only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Epinko Teknoloji, not Apple, is solely responsible for the App and its content, including:
- Any product warranties (whether express or implied by law), to the extent not effectively disclaimed.
- Any claims relating to the App's failure to conform to legal or regulatory requirements.
- Any claims arising under consumer protection, privacy, or similar legislation.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
- Epinko Teknoloji, not Apple, is responsible for addressing any claims you or any third party may have relating to the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the App infringes that third party's intellectual property rights, Epinko Teknoloji, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or has been designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

11. Google Play-Specific Terms
For Users Who Downloaded from Google Play Store
The following terms apply in addition to the above:
- This EULA is between you and Epinko Teknoloji only, not with Google LLC ("Google"). Google is not responsible for the App or its content.
- Your use of the App is also subject to the Google Play Terms of Service.
- Google is not obligated to provide any maintenance or support services for the App.
- Google is not responsible for addressing any claims by you or any third party relating to the App.
- In-app purchases and subscriptions are processed through Google Play billing and are subject to Google Play's terms and refund policies.
- You acknowledge that Google has no obligation to investigate, defend, settle, or discharge any intellectual property infringement claims.
12. General Provisions
12.1 Governing Law
This EULA shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
12.2 Severability
If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12.3 Entire Agreement
This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Epinko Teknoloji regarding the App and supersedes all prior agreements and understandings.
12.4 Waiver
The failure of Epinko Teknoloji to enforce any provision of this EULA shall not be deemed a waiver of its right to enforce that provision or any other provision in the future.
12.5 Assignment
You may not assign or transfer this EULA or your rights hereunder without our prior written consent. We may assign our rights and obligations under this EULA without restriction.
12.6 Updates to This EULA
We reserve the right to modify this EULA at any time. Changes will be communicated through the App or by updating this document. Continued use of the App after changes constitutes acceptance of the revised EULA.
