End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and DINCER YUVA ("Company", "we", "us") regarding your use of the SMSKey - Virtual Number application ("App").
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.
1. Agreement to Terms
By accessing or using SMSKey, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the App.
2. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for your personal, non-commercial purposes on devices that you own or control.
3. Service Description
SMSKey provides users with temporary virtual phone numbers to complete account verification processes on various online platforms. Our services include:
- Virtual numbers from over 50 countries
- SMS verification for 500+ online services
- Instant SMS delivery
- Credit-based payment system
4. User Eligibility
Age Requirement: You must be at least 18 years old to use this App. By using SMSKey, you represent and warrant that you are at least 18 years of age.
5. Acceptable Use
You may use the App only for the following lawful purposes:
- Social media account verification
- E-commerce platform registrations
- Messaging app verifications
- Other legitimate online service registrations
6. Prohibited Activities
The following uses are strictly prohibited:
- Illegal activities, fraud, or any unlawful purpose
- Spam, phishing, or malware distribution
- Unauthorized access to other users' accounts
- Reverse engineering, decompiling, or modifying the App
- Copying, distributing, or sublicensing the App
- Using automated systems, bots, or scripts to access the service
- Circumventing security features or access controls
- Violating any applicable laws or regulations
- Harassing, threatening, or harming others
7. Account and Credits
7.1 Device-Based Account
SMSKey uses a device-specific identifier to manage your account. Your credit balance is tied to this device identifier. Credits cannot be transferred between devices.
7.2 Credit System
- Credits are used to rent virtual numbers for SMS verification
- Unused credits do not expire
- Purchased credits are non-refundable
- Credit prices may change without prior notice
8. Subscriptions and Payments
8.1 Subscription Plans
- Weekly Subscription: Automatically renews every week
- Monthly Subscription: Automatically renews every month
8.2 Billing
- Payment is charged to your Apple ID or Google Play account upon purchase confirmation
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Renewal charges are billed within 24 hours before the end of the current period
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
8.3 Cancellation and Refunds
- You may cancel your subscription at any time through your App Store or Google Play account settings
- Cancellation takes effect at the end of the current billing period
- No partial refunds are provided for unused subscription periods
- Refund requests are subject to Apple's or Google's refund policies
9. Intellectual Property
The App, including its source code, design, logos, trademarks, and all related intellectual property rights, are owned by DINCER YUVA. This Agreement does not grant you any intellectual property rights in the App.
10. Third-Party Services
The App uses third-party services (SMS-Activate) to provide virtual numbers. The availability and performance of these services are beyond our control. We are not responsible for any issues arising from third-party service providers.
11. Disclaimer of Warranties
Important: The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
- We do not guarantee that the service will be uninterrupted or error-free
- We do not guarantee that virtual numbers will work with all services or platforms
- We are not responsible for third-party platform policy changes
- We make no warranties regarding the accuracy, reliability, or completeness of the service
12. Limitation of Liability
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid in the last 12 months
- Some jurisdictions do not allow limitations on implied warranties or liability, so some of these limitations may not apply to you
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company from any claims, damages, losses, and expenses arising from your use of the App or violation of this Agreement.
14. Termination
- We may terminate this Agreement at any time, with or without notice
- Your account may be suspended or terminated if you violate these terms
- Upon termination, you must cease all use of the App
- No refunds will be provided for unused credits upon termination
15. Modifications
We reserve the right to modify this Agreement at any time. Significant changes will be notified through the App. Your continued use of the App after changes constitutes acceptance of the modified terms.
16. Apple-Specific Terms
This Agreement is between you and DINCER YUVA, not Apple Inc. Apple has no obligation under this Agreement.
- Apple is not responsible for providing maintenance or support services for the App
- Product warranty responsibility lies with us, not Apple
- Apple is not responsible for any third-party claims that the App infringes intellectual property rights
- Apple and its subsidiaries are third-party beneficiaries of this Agreement
- Upon your acceptance of this Agreement, Apple has the right to enforce it against you as a third-party beneficiary
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple has no other warranty obligation with respect to the App
17. Google Play-Specific Terms
For users who download the App from Google Play:
- This Agreement is between you and DINCER YUVA, not Google
- Google is not responsible for the App or its content
- Google has no obligation to provide maintenance, support, or updates for the App
- To the extent this Agreement conflicts with Google's Developer Distribution Agreement, Google's terms shall prevail
- Google and its subsidiaries are third-party beneficiaries of this Agreement
18. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be resolved in the courts and enforcement offices of Istanbul.
19. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the App and supersedes all prior written or oral agreements.
